“문제는그통치하는사람과법의관계다.통치자위에법이자리하는경우를우리는‘법의지배(RuleofLaw)’혹은‘법치주의’라이름하고,반대로통치자아래에법이자리하는경우를‘법에의한지배(RulebyLaw)’라한다.전자의법은국민의자유와권리를보호하기위하여권력을통제하고억제하는법이다.후자의법은통치자가권력을행사하는수단이자폭력으로서의법이다.전자의법은인권과평화와민주주의를담아내는그릇이지만,후자의법은국민을정치로부터소외시키고타자화하는통치전략이흘러가는통로를이룰뿐이다.그래서법이정치를규율하는민주사회와달리권위주의사회는법이아닌,법의외관을띤폭력을정치의수단으로삼는다.법으로써국가의폭력을은폐하고또엄폐하고자하는것이다.”
